I've noticed that if the 8 ball is potted off the break it is re-sited and the same player continues. Surely rhis can't be right.

In the rare event when 8-th ball was pocketed during the initial break, GC previously had an incorrect imoplementation -- the player who pocketed 8th ball on his/her break lost the game. At this time, GC adopted one of two standard ways of dealing with this event - repetition of the break by the same player.

For 8 ball pocketing on the break, the 8-th ball is re-spotted & the game continues without change of turn. If there was a scratch as well, then the turn is changed, black ball is re-spotted and the game continues.
From Billiard Congress of America rules:
'... 4.8 8-BALL POCKETED ON THE BREAK If the 8-ball is pocketed on the break, breaker may ask for a re-rack or have the 8-ball spotted and continue shooting. If the breaker scratches while pocketing the 8-ball on the break, the incoming player has the option of a re-rack or having the 8-ball spotted and begin shooting with ball in hand behind the head string.'

According to the statutes of most states in the United States, gambling is defined as: "risking something of value upon the outcome of a contest of chance". (Also see No Gambling!). The skill (as opposed to chance) is predominant in games of skill. Playing games of skill for $prizes, therefore, has nothing to do with gambling as it is not a contest of chance -- the more skillful player will win far more often. The chance element of a 'gamble' is either insignificant or missing. When players compete in tournaments or games of skill for $prizes -- it is "competitive entertainment" rather then "gambling". The more skilled winner will always win more matches, tournaments and $prizes.
